New Emotional Support Animal Law: What’s It All Mean?

 

  This year, the Florida Legislature passed a bill affecting emotional-support animal guidance in Florida. The law creates new clarifications for emotional support animals. It’s important to understand exactly what it does – and does not – do.

Last month, Florida Realtors notified members of a new law, effective July 1, 2020, in relation to service animals. As mentioned in the article, the law was largely written to address the abuse of “online certificates,” which allege to be the gold standard in determining whether or not an animal is a “true” emotional support animal (ESA) or not.

2020 Florida Homestead Exemption Filing

All legal Florida residents are eligible for a Homestead Exemption on their homes, condominiums, co-op apartments, and certain mobile home lots if they qualify. The Florida Constitution provides this tax-saving exemption on the first and third $25,000 of the assessed value of an owner/occupied residence. While a complicated formula is used to explain this -- as the additional $25,000 only applies to the non-schools portion of your tax bill -- the bottom line is that the basic homestead exemption saved a Broward homeowner in 2019 anywhere from $665.54 to $1,085.53 (depending upon your city's millage rate) in annual tax savings for all homes with a value of $75,000 or higher.

During a Hurricane, if an evacuation order is issued, Florida law allows condo associations to shut off elevators, water and sewer.

Some condominium buildings shut down their power as Hurricane Dorian approached the town, forcing residents to either evacuate or endure miserable conditions.

One elderly resident was so desperate, he pulled the fire alarm in his building, even though there was no fire, so Palm Beach Fire-Rescue would come to his aid, Fire Chief Darrel Donatto said. The man couldn’t get down the stairs to exit the building without help.

Florida Condo Insurance is going up in 2019 according to the experts.

Two things in Florida that will increase in 2019 is the average age of residents, and the cost of home insurance, and this includes condos.

In 2018 there are reports that over 85,000 homeowners have been dropped by their insurance companies, and these homeowners are forced to find alternative coverages which are typically more expensive. According to the experts, this will affect all types of insurance coverages, including condos and co ops around the State of Florida.

This is a question we are asked frequently:  Do I need to Re-apply each year?

Answer: (In Broward County)  No. Each January, Broward County mails a Renewal Receipt/Change Card to every Homesteaded property owner in Broward. If there are NO changes to the use and/or ownership of the property, simply keep the card as your receipt that you were automatically renewed for another year. However, if there are changes, please mark the Change Card accordingly and return it to their office. If you live in a county other than Broward, you should contact the County Property Appraiser's office to confirm their proceedure...
